  • Can boss not pay you in California?

    My husband just moved to the US & is legal with SS #, we found him work at a moving company. We met up with boss at the warehouse yesterday to discuss my husband's employment like getting more info regarding wages, times, days, etc. The boss said that he pays at the end of the day, and tips get distributed equally & that there will be 2 other guys. I was also present with my husband. The boss said he pays helpers $17/hr & that he is going to have my hubby work the next day to see how he does before deciding if my hubby should come back again the day after for good. So today my hubby went to work for 1st day, worked 8 hours like a slave & came home tired, then he called the boss to inquire about his pay for those 8 hrs, but the boss said that he doesn't pay for the helpers on 1st day of testing them! So that was surprise as he didn't mention that part to us & my hubby is upset now that he isnt getting his pay after 8 hrs of physical work. We live in LA...is this legal even if the boss was going to pay hubby cash?

  • Affidavit of Support immigration I-864 question ?

    I am filling out my AoS for my wife's upcoming interview and sponsoring her myself and everything is fine except that I am a little confused as to how to treat the "annual anticipated income" because my latest 2020 tax return totaled $48,560 of which I earned a) $24,550 as a self-employed landlord collecting rent, and b) the rest was UI benefits that I was getting. So now this year (2021) I am still self-employed collecting rent and my income from rental is the same as it was for 2020 which was and is $24,550 as already mentioned, but since I am still collecting unemployment this year too, I'm a little confused about how to incorporate my UI now into my "annual expected income." Do I add whatever I have been getting from January 1, 2021, until today (mid-March) and only then add the approximate amount oh how much I can get until September since California extended UI until September, or do I just stick to my landlord self-employed income of $24,550 for my 'annual anticipated income" by not counting UI at all into this year's income even though I am getting that income? it's just that UI is what's confusing me and not sure how to treat it for that specific question. I'd appreciate clarification based on these facts regarding my income. Thanks.

  • Joint Sponsor & Unemployment Benefits?

    Coronavirus has confused my case a little & I'd love some advice. Our case is under CR1 category with spouse living overseas & we were waiting for the interview last year but the US Embassy shut down and canceled the spouse's interview. Been waiting a year to finally have the interview & it is coming up soon. Last year I had submitted my and joint sponsor's I-864 forms along with supporting docs to the Embassy portal CEAC. I used a family friend as a joint sponsor 'just in case' who at the time last year was working as an assistant professor at an art college but last March she was temporarily laid-off when corona began & been getting unemployment benefits only (for a year now). She is due to go back in September once colleges resume in-class courses. I know that UI is not a public charge thing so my question is the following:

    1) If her UI meets the minimum povery guideline for two that she's been earning since last March, can I use her again through a new I-864 form where I just include her UI earnings as current annual income? UI is still an earned income isn't it? Is UI bad on I-864? 

    2) Im a self-employed landlord (finishing certificate in college soon) but filed for UI myself last March because I read that landlord $ is considered passive income & you can get UI while also getting $ as landlord like one doesn't hurt the other. Is this bad for my I-864 that I was getting UI too although my landlord earning is above the povery guideline for 2 people in california

  • Green card question?

    I petitioned (CR1) for my spouse who lives overseas back on December 15, 2018 & his interview was going to take place on March 1, 2020, but because of the pandemic & because he had to fly to the neighboring country to attend his interview, the borders closed so he didn't get to his interview the whole year. Now that he has a new interview date (at end of March) & we have a new president, I wanted to know what happened to that DS-5540 (public charge questionnaire) because 1st it became mandatory in 2020, then mid-year, I think it was canceled, then people said it should be still filled out & assets shown for his interview depending when the petition was filled and not when his interview is, so this is really confusing now. Have your clients been asked for DS-5540 at the consulates/embassies this year? I can't find info on this online. Is my spouse required to show his own assets with that DS-5540 form based on our petition date or the law as of now in March?

  • Was the doctor out of line?

    I purchased a 20 unit botox at a new clinic. I thought I was getting just the 20 units, but when I went in, the doctor suggested a total of 70 units ($8 units each) and since I already paid for the 20 units through Groupon, I was going to end up paying additional $400 for the rest of those 50 units. I didn't anticipate to pay that much, but as a first time customer, I was given a discount on that $400 so I paid $368 plus the $120 through Groupon. I never get 70 units as I'm 37 years old, but I went along with what the doctor said. However, I must mention that I have nice full natural lips that I always get complimented on by men lol so I was surprised that I went in for my botox, yet when the doc met me he says "so what are we doing besides botox? your lips!" I was startled as I never even considered to do my lips, so I told him that I like my lips, then he proceeded to tell me that I have nice definition to them but an injection would enhance it more. I didn't like the suggestion since I've never been told by other doctors to get my lips injected so I felt a bit offended...Im not sure if im looking more into this than I should or if the doc was not ethical in some way to suggest the injection even when I made it clear that I like my lips?

  • Personal Injury Question?

    I have a question related to Pprsonal injury. My attorney billed 30K to the insurance as demand for not my fault accident 2 years ago but we were offered $20K only by the ins. I did't agree with that $20K & asked my attorney to send them a final offer of $25K to get it settled without lawsuit around 7 days ago so we are still waiting for the adjuster response. My chiro doctor who is a close friend of my friend asked to meet up with him & when I did, he told me that $20K is not enough & that I should pursue lawsuit as it opens the claim for more. Although I was hoping to get much more & was surprised for the low $20K, I no longer want to move this forward. I wanted some understanding such as whether the chiro doc wants me to go down the lawsuit route so that his medical bills will be paid in full along with the clinic where I got my epidural shot? Im not sure how the med bills work but if my attorney had sent the demand for $30K does it mean that it was all for the med bills only totaling that much or the meds were less than that $30K & she also demanded extra for her part of 30% & my 30% to all fit into that $30K demand of hers? She's out of town now so cant ask her & wanted clarification as to how the demand works. Im thinking that an attorney wouldnt demand $30K if she didnt feel that it will cover all medical costs I had plus both of our share of $30% each, right? Also, if they end up paying me the $20K, am I responsible for all med bills from my own pocket from my 30%?

  • Green card re-entry permit I-131 form?

    Hi. My cousin got a g.c. through her US citizen dad and she arrived in the US 2 years ago staying Nov-Feb in '18, but she decided to first visit the US only as she had unfinished business in her homeland so she returned back after her 2-month stay here, but she petitioned for a re-entry permit so while she was going to return in a year (around last March), due to corona, her plans changed so she stayed in the homeland for another year (2 yrs total) Her re-entry permit is expiring in Feb now, so she is about to visit in a week (mid-Jan) to make it before the expiration now that airlines are working. She will stay for 2 weeks this time only & will leave again to her homeland for another year until she sells her business and is ready to permanently move to the US so our question is the following regarding her current re-entry permit that will expire after she arrives in the US: can she extend that re-entry permit passport that she has, as in file some type fo extension, OR that passport becomes invalid in February & we would need to re-apply for her I-131 from scratch all over again? I don't know if there's such a thing as extending the current re-entry permit or not. I will help her filling the app but I wanted to know if the biometrics is needed again like 2 years ago for her re-entry or not? Please advise only if you have done it or have knowledge of re-entry permits. Thanks

  • Unemployment benefit denial question?

    So a relative applied for unemployment in Cali but was denied in a letter where EDD asked to verify his identity and requested a copy of his ID to be sent within a certain period of time. He got sick and unfortunately missed the appeal deadline which was 11/25 to present his ID and now he wants me to help him re-apply again beginning of January. Can you re-apply all over again for unemployment if you were denied and missed the appeal deadline or do you get just 1 chance to apply and see what happens?

  • Amazon return processing timeframe?

    I had an Amazon account which just got closed due to returns. It got closed on Dec. 4 while I had sent back my items mid-November to get refunded and they received at their warehouse on Nov 23 @ 11pm. Now, whenever I drop off something at amazon I get an automatic refund, but specifically for these returns which went to some other Amazon warehouse in KY, it didn't generate an auto refund and before my account was closed, even though they had received it according to the tracking, it still says 'we will refund u when we receive your return' and today is dec 6 and still no return for those $600 items that i shipped back in a few packages. My question is how long it takes them to process a refund anyway? There was no issue with these 7 different shippments back to them although they were 1 order but the system generated several returns labels all going to the same amazon warehouse! Can someone tell me when it expects the returns im not even sure if they process returns during the weekends there was also one day for thanksgiving so im not sure whether to worry or not at this point as Im missing $600! How long it takes you to be refunded if not an automatic refund upon getting it scanned at UPS? Im thinking that if everything was returned in 1 box then perhaps it would have been lost but none of these 7 returns within 1 order are getting refunded still so im worried. It can't be that all 7 packages were lost at the warehouse right? all at once lol

  • Amazon closed my account?

    Amazon closed my account for returns. Meanwhile, I had purchased an iPhone for $300 which I returned back unused as I had purchased another one on craigslist but the iphone was shipped back in the morning while they closed my account in the evening so the iphone is still on its way back to them & im worried about my refund now wondering if their return label with the RMA is automatically void or not? I had also sent back a return worth of $600 which arrived to them on Nov. 24 and today is December 6 & while my account was opened all that time, I was still waiting for the refund & now that it closed how would they process the returns for me so i can get my proper refunds? I have the tracking #s & evidence of the sent items. Will I still be able to get an automatic refund confirmation email from amazon when they process my return even with a closed account? im trying to figure out if all orders are voided when they close accounts or not so? What can I do to get back my refunds that they have the stuff?

  • re charging my credit card?

    Hi. I purchased an amazon order where the package arrived as ripped and my facial cleanser was missing and one of the other items was a different product in the order. I got an automatic refund for my facial cleanser but sent back the wrong item to only receive an email from Amazon saying that they will have to re-charge me for the wrong item! m pretty upset about it not only for the $5 missing facial cleanser but now they are re-charging me for sending me the wrong item that i sent back and an automated refund for it. I canceled my card on file and contacted them but haven't heard back yet. I don't get at which point the facial cleanser was stolen because the package was amazon prime and delivered by amazon driver. It seems to have been unevenly ripped open using a knife but only the facial cleanser was missing, but i got my refund for it so thats just part of being upset, im more worried that they want to re-charge me for the returned wrong item. I had ordered tommy hilfiger sweater and got something different by tommy hilfiger so i shipped back and got my refund. Will the cancellation of my credit card on file stop them from re-charging me because now i dont even have the wrong item they sent me as iit's shipped back. I never had this happen and im pretty upset about this issue. How can I prevent them from re-charging me now is my issue?

  • Where its best to buy a used car in cash?

    I want to buy either BMW 4 series or Benz 300 no earlier than year 2018 (newer the better) and I have enough cash to pay it that way but my question is where to go to get it cheaper? Dealership of both? Private dealerships where they buy and sale random cars? Who tends to add more commission on the true value is what im trying to find out and avoid. Also, if I am paying in cash does it matter in terms of getting a discount? Is that something better for a dealership/private dealership? Also, can I ask them to sale it to me tax deducted meaning that the tax i would have had had i financed or leased, would be deducted when paying cash? I really dont know much about car buying and would appreciate tips and help in trying to figure out the advantage for me and for the seller when paying/receiving cash for a car. thanks

  • DMV question?

    I live in Cali and had purchased a car financed through bb&T bank. I ended up paying off my car within 2 years instead of the full term so bb&t bank sent me a letter as proof of the pay off and a release of the lien in the letter they attached a title too....im not sure what I need to do with the title of the car now that i fully own my car and the lien has been released by them? Is it just my own copy or am I supposed to send the original to DMV? Im confused...thanks.

  • Amazon returns question?

    I just registered an account with amazon and made purchases for various prices for stuff sold by Amazon instead of sellers. Upon a few returns, I did not get an automatic refund once the return was dropped at UPS. I am a little confused about why I didn't get a faster refund because my sister has been using Amazon forever now and for all her returns, once she drops her stuff at UPS to be returned, Amazon issues her an automatic refund. Is everyone else getting auto refunds unlike me? I would prefer to get my refund fast just like my sister so I wanted to know why I am not being generated the auto refund and instead have to wait until the stuff gets back to their warehouse? Is there a way for me to change my new account to how it is with my sis? Thanks.

  • Contract question?

    I rented mailbox to ship my orders there. This was a week ago when I rented it. The owner gave me discount from $30 to $20/month for 3 month period verbally. I paid $71(tax & key deposit included). Within a week I attempted to purchase stuff from various merchants like Target, Walmart, Rack, Nordstrom, Bloomies, and all canceled the orders & I kept the cancellation emails. It was due to lack of verification for the address. I called the owner to see what's going on & he said that few other people have said the same to him. Well now if I cant get the mail sent to my new address so why would I need it? I kindly explained & requested refund for at least $63 minus the key deposit, but he is refusing saying that I signed a contract. Well what happened is that he took my ID, took down the info & SS #, filled out paperwork for the postal service himself (I did nothing) & only stuck the form to me to point where to date/sign. I never received a copy of the signed form even when requested for my record besides a regular receipt of the $71 credit card charge. No idea what 'terms' hes talking about if he isnt presenting those terms as a copy to me. What can I do as I feel cheated & dont want to gift someone my $ if the mailbox turned out to be no use for me of no fault of my own?

  • my friend is mad...was I right?

    met up with my female friend (im a f) last week, we decided to go for a 30 minute walk today but since then the weather in LA is record high at 115 degrees for a few days. due to the scorching heat i assume that no one would want to be randomly walking in the street at 4pm in the afternoon. It's really bad here. So i didnt contact her today (Monday) to check in regarding 4pm plans we had, and didn't hear back from her until 4pm telling me that she's next to my house having iced coffee. I was surprised since i usually touch bases about going out earlier any day we decide to go so i dont know why randomly she would come next to my house at 4pm wanting to walk in this crazy heat...there's nothing pleasant for me to walk in the heat and i already did my exercise at home (walking was the exercising for us) so im safe in my house under air conditioning. I felt that she got upset but im more annoyed that she wouldn't bother text a few hours earlier at least to double-check if we are still on regardless of the heat or not. I always touch bases the night before or early the day of the plans but i never contacted her neither did she until 4pm. Am I right to be annoyed too since it wasn't that hot a week ago so we both didnt know about the 115 degrees today. I dont see how a normal person would enjoy walking under the sun. I know I don't. Am I not right?

  • Unemployment Benefit Question?

    This question is for the ones getting it. I applied in CA online and quickly was approved due to my laid off work starting from 3/15-12/31. The total benefit amount given between those dates is $6,500 (approx), so as instructed, I logged in & claimed the benefit for each week since mid-march until mid-august right now and got around $3,000+ benefits so far although I still have a balance of that much left. Once the debit card from BofA arrived, I was expecting that so far my $3,000+ money (as shown in my EDD account) I claimed would be shown but once I activated the debit card & upon setting up an online account on BofA to monitor my future balances/statements & see that there's $13,500 balance!! What is that $13,500??? Why does EDD show they approved me for $6,500 yet I already have a balance of $13,500? Why then EDD isn't sowing a confirmed claim amount of $13,500 in my account between 3/15 I claimed and end of this year when it ends? Why is only the debit card has so much $13,500? I'm totally confused yet happy but need to understand what is going on? I haven't touched that $13,500 yet not knowing why I got twice as more than what EDD has for me in my EDD account?

  • Credit card charge back dispute claim with Wells Fargo bank?

    I purchased from Nordstrom Rack a $200 designer item but they sent designer jewelry instead. I reported the issue & shipped back the wrong item to Rack but was told by them that it's not the correct jewelry according to the tag. The jewelry had the D&G tag attached to it with documentation & a case. I was upset as i waited for my refund so i read many reviews about the Rack & how others also got tons of wrong items from what they had ordered so it seems like something is off with their warehouse. Now they are not refunding me my $200 for the wrong designer item even though they received it back & confirmed that they got it! My concern is my $200 now & i wanted to know if I can do a chargeback? The problem is they just deactivating my account with them. My question is if I contact my bank to do dispute, will the Rack/merchant be able to respond to the chargeback on their end because when I contacted Rack to check on my return, the customer service said that she has no access to my account as it's deactivated now, so how will they respond to my Wells Fargo chargeback now if it seems that they also dont have access to my account just as I cant access it myself. I guess from what I understand once you deactivate an account it disappears. I just want my money back because they didnt even return the wrong D&G jewerly back which i would have sold for $200 or less to at least get some of my $ back. Any way to get back my money through charge back?
