How can a Girl of 16, that took lewd photos of herself be considered both a minor and a Adult?

It seems to me, that if they charge her as a Child for taking the lewd photos, then the charges would stand.

But if they charge her as a adult, would she then be considered a adult in the photo, and hence no law broken??

It seems to me that the Government wants their cake and eat it too. They want the photo to be of a minor, and charge the same minor as a adult, but in my opinion if they charge the minor as a adult, then the subject of the photo should be seen as a adult by the law, and the photo would not be illegal. Charges Dropped.

    Those laws are there to protect the minor from themselves...you should be fully aware of the power of the internet today.

    They wouldn't be charged, if they were 18+. If younger, I could see why.

    well, if she was with someone under the age of 14, they can charge her as an adult for a statutory rape crime, or internet porn, as children may be exposed to it.

    if the girl would be tried as an adult i do not see why it would be illegal either?
