Is it legal for your mother to sign checks written to you when you are a minor and to put them into her own?

bank account without telling you? I should have received a rather large portion of my grandfathers will, which was recently brought to my attention by the executor of the will (my aunt). All of the checks were written to me in my name and my mother signed them (in my name) and put them into her own accounts/ spent the money all while assuring my aunt that she was setting it aside for me. Now, six years later, I am finding out about this when my aunt asked if I had ever received any of it. Are there legal actions that I can take? Or, can she claim the money Because I was a minor (16-17) at the time?

*** I am not concerned with ruining any relationship with my mother since that relationship is non-existant.

*** The money was most definitely not used for me in any way, shape or form. I am active duty Navy and have received my college degree for free.

    Legally the money should have been put into a custodial account because you were a minor. The custodial account would have to have an adult in charge of the account. That adult, the custodian is supposed to act on your behalf.

    If you think you have a case, you should speak to an attorney. Keep in mind, if the money is gone, there is not much sense in taking your mother to court. If there is no money to recover, it will likely ruin whatever relationship you have with your mom, no money will be recovered, and you will spend money for a lawyer.

    Under no circumstances was this your mother's money. Did you go to college? If you did, who paid for it? Was it paid from this money?

    If you were a minor, your mother could certainly cash the checks, keeping them is another story. If there is a written copy of how your grandfather's estate was to be handled, you could sue your mom. If not, you might be out of luck.

    Inherited monies should be placed in trusts so this doesn't occur.
