Will The Foreign Account Tax Compliance Act (FATCA) apply to the Duke & Duchess of Sussex's Royal baby, since it's born to a US citizen?

    No, because their child will not be born a citizen, it will be born with the automatic right to claim citizenship by descent. There is a difference.

    Yes unless the baby relinquishes its citizenship.

    Meghan is still a US citizen. It is through her that the Sussex child can claim dual nationality. The baby will not have an income to report.

    The law does not include a provision imposing any tax.

    No, it not a US citizen. No you don't gets no tax.

    I think swearing loyalty to a foreign crown (the one you rebelled against in 1776) means the Duchess is no longer a US citizen. Same like Canada.

    No, because the child IS NOT a US Citizen by birth.

    Update: Even if the mother is a US citizen, it the child is born outside of the US and the father is not a citizen, the child IS NOT a US citizen by birth.

    IF the child were to have dual citizenship, as a US citizen, it would be subject to US tax law.

    The baby will be born in England, that does NOT make it American.

    No it won't because it will be a British citizen. Not a US citizen.
