"Photos of people that got arrested and or incarcerated." Do you mean "mugshots?" In the last 24 hours, you asked six "mugshot" questions. Obsessive much?

B would essentially be mug shots, and are public records.
A could be public records....depending on who took the photos. If it was the school that took the photos, then they could be public records. But most likely not.
So I'd just stick with B.
