Will I be in trouble if I immigrate?

I am in an abusive marriage. I have a 2.5 year old and going the divorce way will be traumatic for the kiddo considering how my partner and his family is. They will want my kids custody and they will go to any length to get that, just so that they will have that win feeling and not cause they care about the kid. The whole process may take years and my child will lose his childhood through it. The only option I have is to trick my partner into signing a sole custody certificate and migrate to Canada. Will I face any trouble if I do so? Can they torture me there too?

    Politically Correct, you can't just sit down and talk with an abuser. If you do that, the abuser might try to kill you.

    The Canadian government isn't known to torture people. But whether your custody documents would stand up to legal scrutiny would depend on what you mean by "trick". Then there's also the question of whether you even qualify to immigrate to Canada. Canada isn't the US and you can't just "migrate" there like a bird crosses international borders.

    Unless you already are both Canadian citizens and already have a Canadian passport for you kid, you are not migrating there ( or nowhere else)... when you get divorced when there are children from the marriage all that is dealt with at the same time as the divorce, so you will be 'tricking' no one

    There's a mountain of paperwork involved when it comes to immigration of a minor to another country. Your abusive spouse would have to sign at the Canadian consulate the paperwork allowing you to take "his" child out of "his country. I can't imagine a situation where this is going to work.

    Unless you and your son both have Canadian passports you are not moving there.  You are going to have to deal with this situation like an adult.  Children run away and hide, adults solve problems.  Sit down and talk to him.  If you hate his family, talk to him about moving elsewhere.
