Can my friend have her husband deported from UK? He has leave to stay now...?
My friend has an abusive husband who she wants to divorce. She met him in Pakistan and he has turned abusive since he received his leave to stay. Can the Home Office deport him and if so how does she go about it? He has physically and mentally abused her and she has had 5 miscarriages because of it.
He has told her she cant throw him out and he will take her house and everything else - which she boguht before she married him
Any advice or who would be a good person to speak to? Recommendations? Much appreciated. THANK YOU!

no she cant have him deported if he has unlimited leave to remain.
She can divorce him and have him arrested for the divorce.
As for the house even though she bought it before they married. he will be entitled to some of the money from it. The way the court figures it is they take the amount of time they ahve been married and how much he has contibuted to the family buget and they come up with a number from that,
If they have been married a short time then he will get next to nothing to nothing. it takes like 20 years of marriage before he gets and substantial amount.
He is here on his own accord after he gets ulimmited leave to remain status he is no longer here because of her.

She needs to talk to a lawyer and her doctor. Lawyer for legal advice and doctor to see if he will testify that the miscarriages were normal, stress induced, could have been avoided etc. Also see the police and make sure that any abuse is properly documented and there are any pictures of bruises caused by the husband.
If she can claim that her husband entered the marriage under false pretences then they can take away the ILR, if not it's a different story.
I doubt he'd get everything. If she entered the marriage with the house and everything else he'd be able to get a portion of it. *grins* If the judge orders them to be sold sell them for an exceedly low price to a trusted family member and give him half of a dollar aka First Wives Club.

What a bully!
Get a divorce lawyer and change the locks to the house, get a restraining order against him. If her name is on the deeds for the house, and he is in the process of getting a divorce he will not be allowed to stay. And she will keep her house
He is trying to frighten her, she needs to remove herself from the situation.
