Libel or slander? Or neither?

I hired an awful wedding photographer. he's trying to make it big int he wedding circle but i want to warn other brides of his awful work. Can i take out a full page ad in a wedding magazine ? Can he sue me for libel or slander? I am just threatening to do it but might just do it if he doesnt give me my money back.

    Just be careful before you do that. While truth is an absolute defense against a libel suit, what is considered "awful" is subjective. Did he do what was required in his contract? If yes, then he can say he fulfilled his contractual obligations. If you say "but the pics are awful," you're going to have to convince a jury in a civil trial that they're basically unusable. Maybe they are, maybe you just aren't thrilled with them. Did he offer a money back guarantee if not fully satisfied? Probably not, so him giving you all your money back is not very likely. He can also sue you on the basis of interference with contractual relations. Basically, if he loses business because of your ad in the paper, you could lose that lawsuit. Your better off writing a letter to the editor of your local paper (or bridal magazine if they have one). Its opinion and he can't sue you for your opinion. (Well, he can, but its opinion, and he wouldn't win.)

    one million. In a talk room, X says that Y is a criminal. Slander. 2. whilst on my own, X tells Y to his face that Y is a criminal. Neither. 3. In a team assembly, X tells Y that he's a criminal. Slander. 4. In a workers document, a supervisor falsely accuses Y of criminal habit, loss of integrity, dishonesty, incompetence, or reprehensible own ethical habit. Libel. one million and 3 are in elementary terms slander, however, if X would not additionally returned up the claims of Y being a criminal.

    If your statements are TRUE, it's not libel or slander. Truth is an absolute defense for either.

    He CAN sue, whether the result would end up as a judgment against you or not. But then you've gotta show up to defend yourself. Is it worth time off work and all that???

    Truth is an absolute defense to charges of libel or slander. In other words, you can say any vile, nasty, unkind thing about him, his work, or even his wife as long as it is true, regardless of your motivations.

    Libel is written lies, slander is spoken.

    libel. Libel = the printed word. Slander = the spoken word.

    Go ahead and try. If it is defamation, the magazine's lawyers will most likely nix the ad. This way the mag has the legal work done for you, and if they never run it, it hasn't cost you a thing.

    You have every right to tell your story, which is true to you, and that is your defense when he sues you..

    Why don't you call your local news station and tell them you have a real human interest story that you want to tell? Contact the Better Business Bureau. Tell everyone you know. He will dig his own grave in this business.
