Car problems please help!?
I'm making payments on a 2002 Ford Windstar that i got from Drive Time. This van has needed repair after repair ever since i first got it and did i mention i'm stuck making payments. I want to give the van back and stop making payments, but i don't want to have bad credit as a result. Can someone please give me some advise on what to do?
No offence Cars4charities but who's going to want to take over car payments on a van that's having mechanical problems.
What legal actions can i take?

If you give back the car, they will sell it and you will be responsible for the difference between what you owe and what they sold it for. A better alternative is to get someone to take over the payments for you.

You can't take any legal action. Nobody forced you to buy that van. You agreed to accept the vehicle in the condition it was in at the time of delivery.
This was YOUR CHOICE and now it's your problem. You have to be mature enough to accept the consequences of your decisions.
It isn't against the law to sell a piece of crap car. Car repairs are a fact of life. Get used to it.
If you no longer want the van sell it, but if you give it back it will be written off as a reposession and your credit will suffer severely. You are obligated to pay back the debt. You borrowed the money you need to repay it, all of it. If you no longer want the van or the debt, sell it. But you can't just give it back.

Letting someone take over the payments is illegal and risky because you will remain legally and financially responsible for the vehicle and loan. If they stop making your payment for you, the lender comes after you, not them.
You can't give the van back without incurring major financial penalties. You don't have any legal actions you can take. You have the obligation to continue to make the payments, Drive Time can take legal action against you if you don't.
