Getting money back from landlord?

We rented a house that was advertised and rented under the belief that it was a 4 bedroom house. One of the rooms was a sleep out not attached to the house. After we moved in it was discovered that the sleep out is not live-able. It is damp and full of mildew and there are holes in the roof. Not to mention no source of light. We talked to the landlord about this and she claims that she warned us the house was a bit of a **** hole before we moved in. My question is, if we were to have someone certify the sleep out as unlive-able, would we be entitled to a quarter of our rent back as we are paying for four rooms.

    If there are 4 seperate contracts, one for each room, then that one contract should be voided and that person moved out.

    Never rent a place you haven't seen! THis is what happens when you do!

    Did the landlord in fact tell you the place was a bit of a ****hole before you moved in? If so what were you thinking when she said that? You should have asked her specifically what she meant by that. For all you knew, you were getting a collapsing house that was about to be condemned, full of mold and rats and cockroaches and caving in ceilings.

    I think that you either void the lease and move or you accept the rent and state of the property and stay. You can try to negotiate with the landlord, maybe she will agree to lower the rent, but for all you know, she has ALREADY lowered the rent from what any other 4-bedroom house in that area would be. For all you know you're paying the rate that 3-bedroom houses go for in that area. Have you compared listings? Doing so would give you something substantial to argue about with the landlord.

    I doubt that "certifying the sleep out as unliveable" is going to entitle you to anything at all. You rented the house as one unit. Rather than dragging in some 3rd party, which will upset your landlord, I suggest just continuing to try to negotiate with your landlord and stay, or else get the lease canceled and move.

    No, you will not get a quarter of your rent back. You won't get ANYTHING back. First off, you accepted the premises and rented them with agreement. You didn't bother to check that sleep out before you agreed to rent ? Second, you are renting more than four bedrooms. You also have a kitchen, bathroom and other space. Why would you think that THESE spaces should cost you a quarter less ?

    I have never heard of a law that would do what you say. Depending on the local laws and state laws and the lease you signed, you may be able to get out of the lease.
