i need advice i was buying a car of my family member?

i paid the insurance and her monthly well anyway we got into a car accident it wasn't are fault it was other driver fault, now there pay out 2,800 to my husbands aunt cause was her car should that money be half ours or all hers she only want to give back 400 what we paid

    Insurance money goes to the legal owner of the car. If the car is in your aunts name, she own it and she gets the money.

    Just because you pay doesn't mean you own.

    Doesn't matter who paid for the insurance or monthly payments. The car is legally owned by your husband's aunt and that is who legally gets the insurance payoff. Legally, she is entitled to ALL the money. Any other arrangement is strictly non-legal between you and the aunt. So why were you paying insurance and payments on a car owned by someone else? That was a stupid decision. But now you know that.

    As the car and insurance was in her name, it it's legally still her car. Offering to pay you back the $400 you had paid is fair.

    Look at it another way, before the accident, they had a car, that they where going to sell to you. After the accident they have what? Only the insurance money. Asking for 1/2 of that is like asking them to sell you the car for 1/2 price. Because you had paid for some of the car, they are offering you that money back. If you had paid for most of the car, and only had one more payment to make, then you should offer you most of the cash back.

    If you had taken out a bank loan to buy the car, and it was written off, you don't get 1/2 the value, and the bank get the other 1/2. The bank gets paid first, and you get what's left over, assuming you have paid off enough of the loan.

    I'm struggling to get through your question as it would seem English is not your first language.

    If the car was in your husband's aunt's name then, yes the money will go to her.

    How much over and and above the total amount you have contributed towards the cost of the car she is willing to give you is a matter for discussing between you, your husband (I'm presuming you only have one) and his aunt.

    If the aunt is a reasonable person she may consider giving you more than you paid in. If she is mean spirited she may decide to keep it all for herself. In which case think carefully before volunteering to help hubby's family members,

    since you did not pay for the car in full, she should return all the money you paid out. Unless the title was in your name, then you owe her the balance of the loan.
