    Does a lawyer in California have to get Malpractice Insurance in order to take clients? For example if a newly admitted lawyer wanted to do a simple will for a family friend, would they have to obtain insurance first or can they take the case, at their own peril, and collect a fee for it?

  • Dad's insurance won't pay for needed treatment...?

    I'll make this as brief as possible...my father has a blood condition; he is missing a chemical in his blood that is essential for his immune system. He receives shots or "infusions" once a month, this has increased in frequency since he was diagnosed well over 20 years ago.

    The problem is, his insurance company will not approve/pay for the treatments any more than once per month. They are very expensive. His condition has advanced to the point where he NEEDS the infusions every 3 weeks, or he starts getting very sick and can't fight off any infections. He was recently hospitalized as a result of one of these episodes. His doctors (three of them) agree that he needs the treatment once every 3 weeks. I am a graduating law student taking the bar exam in July. What can I do/what is the best method for ensuring he can get the treatment he needs? He is in California, where I will be also, he has good insurance, is 68 and otherwise in good health. ANY advice is greatly appreciated.

  • Looking for the text of an Indian Supreme Court Case...?

    Decided in 1980. The only citation I have for it is: Bachan Singh, [1980] 2 S.C.J. 475 (India). It is a case which upheld the Constitutionality of the Death Penalty in India. I am very interested in the way the Court looked at American cases on point, and how they distinguished Indian culture and law from that of Western sources. ANY help is greatly appreciated--thanks!

  • Are there differences between corporations and partnerships in their agency liabilities?

    In other words, are corporations and partnerships able to avail themselves of different defenses than each other, are they liable in different circumstances than each other, etc. Or is the general rule applicable to all business types--that principles are liable for their agents' acts if the principle controls the manner and means of the work, if the agent is within the scope of employment and is not an independent contractor?

    Have a contact claiming to be enrolled at U. of Chicago law, but none of his story makes sense--he messes up dates (when classes begin), won't say the names of his classes, changes the subject if I ask him about certain classes or subjects. Without violating the law or pretending to be someone else and calling their admissions office, how can I find out if he is enrolled?

  • Does a new Law Firm in CA have to register as an LLP?

    Or can it incorporate and run itself like a regular company? I know that CA makes the LLP available to law firms but don't know if it is required.
