Can I Get Evicted?
My husband and I rent a room from someone who sublets a house.
He never gave us our lease to sign so we aren’t on a lease. There is another couple here that is very rude and has tried to fight us many times over petty things. My landlord threatened us all about violating the lease, which states no violence or name calling (which I never did).
This couple has gotten away with everything, and the landlord never does anything about it, even if he talks to them about the rules. But he is never lenient with us. They are not friends and they do not like each other, so it’s not a friend thing. They don’t work or do anything at all but stay home. I am the only one here with a job.
I’m really tired of it and I’m very scared to say anything to him in fear he will say I’m “causing drama and violating the lease” and tell me to leave. Does it backfire if he never made us sign a lease? My address on my license is for here so I don’t think he could lie and say I don’t live here. I just can’t risk getting kicked out but I can’t stand being around people that make my life harder than it already is.

If you don't have a lease, you can get kicked out for no reason as long as they gig you notice, usually 30 days.

of course it doesn't backfire without a lease, in fact it will make it easier to kick you out. the federal moratorium on eviction is only for non payment due to covid

He cannot evict you for violating a lease that does not exist, HOWEVER on a month to month he does not have to give you a reason in most states.
With no lease you legally have a verbal month to month agreement. He can give you a notice to vacate in accordance with your state law at any time. The only exception I am aware of is here in Oregon with our state wide rent control and that only applies if you have lived there more than 1 yr.
The eviction moratorium is only for not paying not for violations.

You can just leave if you want. Give notice and leave. Not sure why you would want to stay. He can give you a notice to vacate at any time since you are month to month. So yes, he can kick you out whenever he wants because you are month to month (with a month's notice).

An unwritten lease is as legit as a written one. You are likely on month to month. He can kick any of you out. But if you are not the one causing the trouble, why would he choose you?

Nope. Nobody can get evicted until June 30th. There’s an eviction moratorium in place so there’s nothing he can do.
Why don’t you record them bothering you.
I doubt anyone would get evicted. Do you know how hard it is to get a tenant that can pay the rent during a pandemic. It’s very unlikely that there will be a bunch of people looking to rent. Unemployment is still high and probably will continue to be until at least next year when there’s a possibility that things will return to normal. When will we reach herd immunity. Maybe fall.
